ARTWORK OR GRAPHICS SUBMITTED BY CUSTOMERS Any artwork, image, or design submitted must comply with the standard format for commercial printing. All color must be in CMYK color mode, minimum of 300 DPI, before submitted for printing. If any artwork, image, or design is not submitted correctly, WT Media, LLC and its affiliates are not responsible for any color discrepancies that occur during conversions from RGB to CMYK or PMS Pantone colors to CMYK color modes., WT Media, LLC and its affiliates are not responsible for images that are pixilated, distorited, fuzzy or otherwise of lesser quality due to low resolution. WT Media, LLC is NOT responsible for converting or checking any artwork, image, or design to ensure it complies with the above format specifications prior to printing – customer is solely responsible for submitting appropriately formatted artwork or graphics. APPROVAL PROCESS Before submitting your order, please review all the information included. WT Media, LLC and its affiliates will not accept any change to any order after it has been submitted. You are responsible in all respects for final approval prior to printing. If the final product contains any errors or mistakes made by the customer, WT Media, LLC and its affiliates are not liable in any way. Said mistakes include, but are not limited to: finished product size, crop marks, wrong cuts, damaged fonts, graphics, misspelling, overprint, die lines, incorrect or missing folds, transparency, grammar, punctuation, and bleeds. WT Media, LLC and its affiliates do not make changes and do not edit customer files. PRODUCT INDEMNITY Customer agrees to the following terms by submitting the above document to WT Media, LLC and/or its affiliates: "I understand that my document will print exactly as it appears here, that I cannot make changes once my order is placed and that I assume all responsibility for typographical and layout errors. I have verified that spelling and content are correct. I am satisfied with the document layout..” DIGITAL PROOFS Digital proofs will exhibit design layout, text accuracy, image proportion and placement, but not color or density. Digital proofs do not accurately show transparency and over print issues that may occur. Digital proofs do not show color discrepancies from RGB to CMYK. WT Media, LLC and its affiliates are not liable for color matching or ink density on digital proofs approved by the customer. Application of UV Coating may affect or change the appearance of the printed colors. WT Media, LLC and its affiliates are not liable for the final color appearance of a UV product/s. WT Media, LLC and its affiliates reserve the right to change the paper quality and/or type at anytime, without notifying its customers. RE-ORDERS Any electronic files submitted for job orders will not be kept in WT Media, LLC or its affiliates’ processing system for more than 30 days after the order date. This means that WT Media, LLC and its affiliates do not accept re-orders of previously printed jobs unless special arrangements have previously been made. Every time an order is placed the associated file must be re-submitted. WT Media, LLC and its affiliates are not responsible for storing any of your files; therefore, keep a copy of your file for future orders. Please contact your account representative if you are unsure about the re-order arrangement regarding your account. PRODUCTION LEAD TIME Next Business Day service: Jobs requesting this service ordered by/before 10:00 AM will be complete and/or shipped the next day by 6:30 PM. Any job that has problems or requires proofs will not be eligible for Next Business Day service. Standard Service: Jobs ordered after 1:00 PM with a lead-time of 1-2, 3-4, or 5 business days will not be considered part of the Standard lead-time. If you do not specify the lead-time during the time of order, your order will be considered 5 days and will be charged accordingly. All times above are EST equivalents. TITLE TRANSFER Shipping terms are FOB shipping point – title transfers when the printed products are in the possession of WT Media, LLC's and its affiliates’ shipping carrier. LIABILITY INDEMNITY The customer shall indemnify and defend WT Media, LLC, its affiliates,and all parties from whom WT Media, LLC and its affiliates have licensed portions of content, including their directors, officers, and employees, against all damages, claims, liability, and costs and expenses, including reasonable legal fees and expenses arising out of or related to:
SHIPPING AND DELIVERY WT Media, LLC and its affiliates will make every effort to ensure that production difficulties do not delay the agreed-upon delivery date. However, neither WT Media, LLC nor its affiliates shall be liable for any damages (special, incidental, indirect, or consequential) resulting from a delay in shipment or delivery. WT Media, LLC and its affiliates are not liable for delays in shipments caused by force majeure, including but not limited to weather conditions, shipping company delays, international customs issues, and any other circumstance beyond the direct control of WT Media, LLC and its affiliates. WT Media, LLC and its affiliates calculate shipment/delivery dates based upon supplier-provided estimates. WT Media, LLC and its affiliates always take action to ensure delivery dates are met. Unexpected malfunction, technical problems and/or equipment failure may delay the production/printing process. In case of delay caused by technical difficulty, rush charges/fees will be credited by WT Media, LLC and its affiliates where applicable – however, technical difficulties are not grounds for order cancellation. WT Media, LLC and its affiliates only use company shipping accounts and will not use customer-provided shipping account numbers for any reason. Orders will be shipped inwhole quantities and may not be split up. WT Media, LLC and its affiliates do not ship to P.O. boxes. ERRORS & LOST PACKAGES Claims for shipping errors, damages, or losses can only be filed for shipments over worth $50.00 or more in value. Any such claim must be made within 30 days after package shipment. WT Media, LLC and its affiliates are not responsible for 3rd-party shipping errors, damages, losses or omissions. POLICY REGARDING RETURN MERCHANISE AUTHORIZATION WT Media, LLC and its affiliates guarantee that prints will not be defective according to generally accepted industry standards. Customers who find that a print is defective may contact WT Media, LLC or its affiliate with complaints seeking a reprint or other compensation. WT Media, LLC or its affiliate must be contacted via email within 3 business days after receipt of the order. If WT Media, LLC or its affiliate deems the product defective, the customer will be offered one of the following: 1. WT Media, LLC or its affiliate will reprint the defective product via the rush production. 2. WT Media, LLC or its affiliate will issue a Return Merchandise Authorization (“RMA”) number to the customer. A Quality Assurance representative will contact the customer within 2 business days of the customer’s complaint/to facilitate the issuance of the RMA. However, it is the customer’s responsibility to contact WT Media, LLC or its affiliate to verify the complaint if a Quality Assurance representative does not establish contact with the customer within 5 business days.. WT Media, LLC or its affiliate must receive the defective product within 10 business days after the RMA number is issued. Compensation will be processed only after a RMA number has been issued and the defective product has been returned to WT Media, LLC or its affiliate. Thereafter, the refund transaction will take place within 10 business days. Samples of the defective merchandise shall be required prior to any resolution of the complaint. INCORRECT ADDRESS SUPPLIED BY CUSTOMER WT Media, LLC and its affiliates will reship any package to the correct address and charge an additional shipping fee whenever a package is not timely delivered due to an error made by the customer in submitting the proper shipping address. WT Media, LLC and its affiliates are not responsible for late deliveriers due to the customer supplying incorrect address information. CANCELLATION OF ORDERS Customers may not cancel or receive refunds for any order that has gone into productionor any process thereafter, including but not limited to coating, finishing and/or printing. WT Media, LLC and its affiliates are not responsible for any error regarding order placed electronically, including but not limited to duplicate orders. All cancellations are subject to the terms indicated below in the Returns/Refunds section and must be requested by email from the ordering party. WT Media, LLC and its affiliates will not make any changes or accept cancellation requests by phone. RETURNS / REFUNDS Customers entitled to cancellation or compensation shall receive refunds in a timely manner. However, up to 10 business days shall be afforded WT Media, LLC and its affiliates for funds to be credited to the customer’s account. WT Media, LLC and its affiliates must be notified by the customer of any defects discovered in any ordered product within 3 business days of order acceptance or the claim will be denied. The customer must return 100% of the ordered product within 10 business days (at their own expense) from the time when the ordered product delivery was received. Charges related to expediting printing (e.g. rush printing or shipping) are not refundable, including any order returned for any reason. |
